Terms of Use

These terms are the agreement between you and GetNerdo. They cover who can use the service, what you may and may not do, how AI output should be treated, billing, and the limits of our responsibility. Please read them.

Pre-launch notice. GetNerdo is in public beta, operated by LumaByte as an online service within the European Union. Everything here describes the service as it is built today.

1.Acceptance of these terms

These Terms of Use (the “Terms”) are a binding agreement between you and LumaByte, the operator of GetNerdo — a LumaByte project provided as an online service from within the European Union (“GetNerdo”, “we”, “us”). By creating an account, requesting a demo, or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use GetNerdo.

If you accept these Terms on behalf of an organisation, you confirm you are authorised to bind that organisation, and “you” means that organisation.

2.Eligibility & accounts

You must be at least 18 years old to create a personal GetNerdo account. Learners under 18 may use GetNerdo only through a participating educational institution that has the authority and any required parental or guardian consent to enrol them; in that case the institution’s agreement with us also applies.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for everything done under your account. Tell us promptly at hello@getnerdo.com if you suspect unauthorised use.

3.What GetNerdo is (and is not)

GetNerdo is an AI-powered learning platform: a tutor, practice and quiz engine, a build Lab, research tools and related features, orchestrated by our “Super Nerdo” system across multiple AI models. You are interacting with artificial intelligence.

AI output can be inaccurate, incomplete or out of date. GetNerdo provides educational assistance only. It is not professional, legal, medical, financial or safety advice, and it is not a substitute for your own judgement or a qualified professional. You are responsible for reviewing and testing anything you act on — including code, commands and recommendations — before relying on it.

4.Beta status & availability

GetNerdo is currently a public beta, offered primarily to businesses and educational institutions and generally provisioned after a demo request. This means:

  • features may change, be added, or be removed, and may occasionally be unavailable or behave unexpectedly;
  • we do not offer a guaranteed uptime or service-level commitment for beta access unless we agree one with you in writing;
  • we may set or change usage limits to keep the service stable and fair.

We will give reasonable notice of significant changes where we can. Any separate written order form, master agreement or institutional agreement we sign with you will take precedence over these Terms to the extent it conflicts.

5.Acceptable use

When using GetNerdo you agree not to:

  • break the law, infringe others’ rights, or submit content you have no right to share;
  • use the AI to generate malware, attack infrastructure, harass, deceive, or produce unlawful, hateful or sexually exploitative material;
  • attempt to bypass security, rate limits, authentication or usage metering, or probe the service for vulnerabilities without our written permission;
  • scrape, resell or redistribute the service or its output in a way these Terms do not allow, or use it to build a competing product by automated extraction;
  • upload others’ personal or confidential data without a lawful basis, or submit special-category data you are not permitted to process;
  • misrepresent AI output as human-authored where doing so would mislead or harm others.

6.The Lab & connected tools

The Lab can execute code in a cloud sandbox, and you may connect external tools such as a GitHub repository. You are responsible for the code you run and the actions you authorise, including any pull requests drafted on your behalf. Do not run code you are not entitled to run, and do not use the sandbox to attack third parties, mine cryptocurrency, or circumvent its limits. Connected third-party services are governed by their own terms.

7.Your content & AI output

Your content

You keep ownership of the content you submit (“Your Content”). You grant us a worldwide, non-exclusive licence to host, process and transmit Your Content solely to operate and improve the service for you — including sending it to the AI providers described in our Privacy Policy. We do not claim ownership of Your Content and do not sell it.

AI output

Subject to these Terms and applicable law, as between you and us you may use the output the AI generates for you. Because AI models can produce similar responses for different users, output is not guaranteed to be unique, and we make no warranty that output does not resemble third-party material or that you will own intellectual-property rights in it. You are responsible for checking output before you use or publish it.

Feedback

If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve GetNerdo, without obligation to you.

8.Our intellectual property

GetNerdo, Super Nerdo, the agents and personas, the curriculum and roadmaps, and the software, design and branding are owned by LumaByte or its licensors and are protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable right to use the service; they do not transfer any of our rights to you.

9.Plans, demos & billing

Access is currently arranged primarily through a demo request and, for Organisations, a written order or institutional agreement. Where a paid plan applies:

  • payments are processed by Stripe; by subscribing you also accept Stripe’s terms, and you authorise recurring charges for the plan and currency you select;
  • we support multiple currencies (including USD, EGP, SAR, AED, KWD, QAR, BHD and OMR); the price, billing period and any seats are those shown at purchase or in your order;
  • unless your order says otherwise, subscriptions renew automatically and you can cancel future renewals from your billing settings; cancellation stops future charges and takes effect at the end of the paid period;
  • fees are exclusive of taxes unless stated, and you are responsible for applicable taxes;
  • except where required by law or stated in your order, payments are non-refundable. If you are a consumer in the EU, your statutory withdrawal and refund rights are not affected by this paragraph.

10.Organisations & administrators

If you join GetNerdo through an Organisation, an administrator may manage your access, assign roles, view learning and usage data associated with your membership, and remove your access. Your use is then also subject to the Organisation’s policies. The Organisation, not us, is responsible for how it administers its members and uses their data.

11.Suspension & termination

You may stop using GetNerdo and delete your account at any time. We may suspend or terminate access if you breach these Terms, if your use poses a security or legal risk, or if we must do so to comply with the law — with notice where practical, and immediately where necessary. On termination, your right to use the service ends; sections that by their nature should survive (such as content licences for feedback, disclaimers, liability limits and governing law) will survive. We will handle your data on termination as described in our Privacy Policy.

12.Disclaimers

To the fullest extent permitted by law, GetNerdo is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service or its AI output will be accurate, reliable, uninterrupted or error-free. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded, including mandatory consumer protections.

13.Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business, arising from your use of (or inability to use) GetNerdo or from reliance on AI output.

Our total liability arising out of or relating to the service in any 12-month period will not exceed the greater of the amount you paid us for the service in that period or €100. These limits do not apply to liability that cannot be limited by law — such as liability for death or personal injury caused by negligence, for fraud, or for infringement of your statutory consumer rights.

14.Indemnity

If you use GetNerdo for business or organisational purposes, you agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your misuse of the service, or content you submit that infringes a third party’s rights. This does not apply to you as an individual consumer beyond what the law allows.

15.Governing law & disputes

These Terms are governed by European Union law and, where applicable, the law of the EU member state from which GetNerdo is operated. If you are a consumer, nothing here removes the protection of the mandatory laws of your country of residence, and you may bring proceedings before the courts there. For any other dispute, jurisdiction is determined by the applicable rules of EU law. We will always try to resolve issues with you directly first; please contact us before starting formal proceedings.

16.Changes & contact

We may update these Terms as the service evolves. When changes are material, we will notify you in-product or by email and, where required, ask you to accept the new version before continuing.
